Anyone in the wellness marketplace that has not heard of the "The Council For Responsible Nutrition" will, no doubt, be shocked to hear that they are nothing more than a front for the pharmaceutical industry. It seems that government and industry has a knack for naming things which obscure the real intent. Remember the "Patriot Act"?

Lena Sanchez, the author of "Are They For Real", an article exposing the slimey underbelly of this organizaton , has to be one of America's treasures. Her no-holds-barred approach to "telling it like it is" is a breath of fresh air in this twisted world.

SEASILVER HIRES RETIRED FTC ATTORNEY TO HEAD UP COMPLIANCE DEPARTMENT...


Last month, we brought on board Michael Dershowitz, a retired FTC Attorney, to head up our Compliance Dept. Mike spent 30 years with the FTC, and brings to us a wealth of specialized advertising law experience.

That means that from now on, we will be reviewing and approving distributor ads in-house. This will greatly shorten the turn-around time for you in getting ad approvals. We must, of course, remain vigilant and compliant with all laws and regulations, and we will do so.

CAN-SPAM ACT OF 2003...IT'S NOW THE LAW...


Now that the CAN-SPAM Act of 2003 is a reality, e-mail marketers must step to a new beat. The full text of the new law can be found at www.spamlaws.com/federal/108s877.html. It's a long document, but one any responsible e-mail marketer should read carefully.

Here are three main points:

  • The "subject" line cannot be misleading

  • You must provide your true identity and your physical mailing address

  • You must provide an "opt-out" link

MLM distributors using any autoresponder system should review each outgoing message in their autoresponder series and make sure that you are in compliance.

How many were your customers? If you do not update and maintain your mailing lists regularly you are going to miss out on a lot of business. E-mail address are changed even more often than regular mail address... so make sure you have a system for updating your data regularly.
